Terms of Service

Effective Date: January 4, 2026

1. Eligibility

You must be at least 18 years old or have legal consent to use our services. You must provide accurate, complete, and current account information.

2. Account Responsibilities

You are responsible for all activities under your account. Keep your login credentials confidential. ExtremeNodes may suspend or terminate accounts engaged in fraudulent or illegal activity.

3. Services and Payments

ExtremeNodes offers VPS and hosting plans at specified prices. All payments are processed securely via our payment gateways. Plans are billed as per the subscription selected and are non-transferable.

4. Refund Policy

Refunds are provided only if the issue or damage is caused by ExtremeNodes. The amount and eligibility of the refund will be determined according to the situation. If the problem is not caused by ExtremeNodes (for example, user error, content issues, or third-party software), no refund will be issued.

5. Acceptable Use Policy (AUP)

You may not use ExtremeNodes services to:

  • Host illegal content, malware, or phishing sites.
  • Perform spam, DDoS attacks, or network abuse.
  • Violate copyright, intellectual property, or third-party rights.

Violation may lead to immediate suspension or termination.

6. Data and Backups

Customers are responsible for backing up their own data. ExtremeNodes is not liable for data loss due to hardware failure, software issues, or user error.

7. Limitation of Liability

ExtremeNodes is not liable for indirect, incidental, or consequential damages. Maximum liability is limited to the amount you paid for the service in the last 30 days.

8. Changes to Terms

Extremenodes may update these Terms at any time. Users will be notified of major changes via email at the address provided in their account.

9. Service Responsibility & Issue Assessment

Refunds, replacements, migrations, or service credits are only provided when a service issue is confirmed by the provider to originate from the provider's platform or systems. The provider evaluates service health and issue origin using internal monitoring and diagnostics. A client's lack of access to provider-level systems or diagnostics does not, by itself, constitute proof of a provider-side issue.

10. Service Relocation Policy

Relocation of services between systems, nodes, or environments is performed solely at the provider's discretion and is not guaranteed as part of troubleshooting or dispute resolution.

11. Client Environment Responsibility

Issues caused by the operating system, software configuration, updates, shutdown behavior, or user actions within the service environment are considered outside the provider's responsibility unless a provider-side fault is confirmed.

Data Backup & Recovery: Clients who have enabled automatic backup services will have their VPS snapshots automatically maintained by our system. In the event of data loss or critical issues, clients may request data recovery or a VPS restoration from a previous snapshot. Clients who have not enabled automatic backups are solely responsible for maintaining their own data backups and recovery procedures.

12. Independent Service Behavior

Each service instance operates independently. Differences in behavior between multiple services, including those operated by the same client, do not automatically indicate a provider-side issue.

13. Issue Resolution Authority

The provider's assessment regarding the cause of an issue and eligibility for refunds, replacements, or service changes is considered final unless new evidence of a provider-side fault is identified.
